Code on Social Security, 2020. The objective of the Code on Social Security, 2020 is to amend and consolidate the existing labour laws relating to social security with the wider goal of extending social security benefits to all employees and workers irrespective of belonging to the organised or unorganised  sector. The Code on Social Security, 2020 brings, within itself the self-employed workers, home workers, wage workers, migrant workers, the workers in the  unorganised sector, gig workers and platform workers  for the purpose of social security schemes, including life insurance and disability insurance, health and maternity benefits, provident fund.

 

The Code on Social Security, 2020 subsumes nine central labour legislations.ie.,  


Ø The Employees’ Compensation Act, 1923,

Ø The Employees’ State Insurance Act, 1948,

Ø The Employees’ Provident Funds and Miscellaneous Provisions Act, 1952,

Ø The Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959,

Ø The Maternity Benefit Act, 1961, The Payment of Gratuity Act, 1972,

Ø The Cine Workers Welfare Fund Act, 1981,

Ø The Building and Other Construction Workers Welfare Cess Act, 1996 and


The Unorganised Workers' Social Security Act 2008.

Chapter 2 is related to Social Security Organisations with Sec 5 to 13. Chapter 3 is related to Employees’ Provident Fund with Sec 14 to 23. Chapter 4 is related to Employees State Insurance Corporation with Sec 24 to 52. Chapter 5 is related to Gratuity with Sec 53 to 58. Chapter 6 is related to Maternity Benefit with Sec 59 to 72. Chapter 7 is related to Employee's Compensation with Sec 73 to 99. Chapter 8 is related to Social security and cess in respect of building and other construction workers with Sec 100 to 108. Chapter 9 is related to Social security for unorganised workers, gig workers and platform workers with Sec 109 to 114. Sec 10 is related to Finance and accounts with Sec 115 to 121. Chapter 11 is related to Authorities, assessment, compliance and recovery with Sec 122 to 132. Chapter 12 is related to Offences and penalties with Sec 133 to 138. Chapter 13 is related to Employment information and monitoring with Sec 139 and 140. Chapter 14 is related to Miscellaneous Part with Sec 141 to 164.

Code on Social Security, 2020, Contains 14 chapters, 164 Sections and 7 Schedules. 1st Schedule Contains Applicability which is related to sections 1(4), (8) and 152 (1) of this Code. 2nd Schedule is related to List of Persons Who Are Employees within the Meaning of the Third Proviso to Clause (26) Of Section 2 of this Act. 3rd Schedule is related to List Of Occupational Diseases. 4th Schedule Part 1 is related to List Of Injuries Deemed To Result In Permanent Total Disablement and Part 2 related to List Of Injuries Deemed To Result In Permanent Partial Disablement. 5th Schedule is related to Matters That May Be Provided For In The Schemes with Sec sections 15(2) and 152(1). 6th Schedule is related to Factors For Working Out Lump Sum Equivalent Of Compensation Amount In Case Of Permanent Disablement And Death. 7th Schedule is related to Classification Of Aggregators with Sec 114(4) of this Act.

The Occupational Safety, Health, and Working Conditions Code, 2020 emphasizes the health, safety, and welfare of workers employed in various sectors like industry, trade, business, manufacturing, factory, motor transport undertaking, building and other construction work, newspaper establishments, audio-video production, plantation, mine and dock-work, and service sectors.The Occupational Safety, Health, and Working Conditions Code, 2020 subsumes 633 provisions of 13 major labor laws into one single Code with 143 provisions. The laws that have been subsumed are:

Ø The Factories Act, 1948

Ø The Contract Labor (Regulation and Abolition) Act, 1970

Ø The Mines Act, 1952

Ø The Dock Workers (Safety, Health and Welfare) Act, 1986

Ø The Building & Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996

Ø The Plantations Labor Act, 1951

Ø The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979

Ø The Working Journalist and other News Paper Employees (Conditions of Service and Miscellaneous Provision) Act, 1955

Ø The Working Journalist (Fixation of Rates of Wages) Act, 1958

Ø The Cine Workers and Cinema Theatre Workers Act, 1981

Ø The Motor Transport Workers Act, 1961

Ø The Sales Promotion Employees (Conditions of Service) Act, 1976

Ø The Beedi and Cigar Workers (Conditions of Employment) Act, 1966.

Chapter 11 is related to Special Provisions for Contract Labour and Inter-State Migrant Worker, ETC with Sec 45 to 93. Chapter 12 is related to Offenses and Penalties with Sec 94 to 114. Chapter 13 is related to Social Security Fund with only Sec 115. Chapter 14 is related to Miscellaneous part with Sec 116 to 143.

The Occupational Safety, Health, and Working Conditions Code, 2020. The Code Contains 14 Chapters 143 Sections 3 Schedules. 1st Schedule it contains List of Industries involving hazardous processes with Sec 2(za). 2nd Schedule it contains List of matters with Sec 18(2)(f). 3rd Schedule contains List of Notifiable Diseases with Sec 12(1) of this Act.

Dear readers in earlier blog we have given Details of 4 New Labour Laws which is not notified yet. From this blog we are providing you Information about Insolvency and Bankruptcy Code, 2016.


So, now will see details about Information about Insolvency and Bankruptcy Code, 2016. This Act was enacted on 28th May, 2016. This Act consolidate and amend the laws relating to reorganisation and insolvency resolution of corporate persons, partnership firms and individuals in a time bound manner for maximisation of value of assets of such persons, to promote entrepreneurship, availability of credit and balance the interests of all the stakeholders including alteration in the order of priority of payment of Government dues and to establish an Insolvency and Bankruptcy Board of India, and for matters connected therewith or incidental thereto. This Act Divided into 5 Parts, Contains 7 Chapters 255 Sections 12 Schedules .
